Notes India, in the Ministry of Finance (Department of Revenue), issued from time to
time, in exercise of the powers conferred by section 14 of the Customs Act, 1962
(52 of 1962) and the relevant date for determination of the rate of exchange shall
be the date of presentation of the bill of entry under section 46 of the said Customs
Act.
SG Notification
Whereas, in the matter of import of Carbon Black (for rubber application) (hereinafter referred
to as the subject goods), falling under tariff item 2803 00 10 of the First Schedule to the Customs
Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the said Act), from People’s Republic of
China, the Director General (Safeguard), in the final findings, vide number G.S.R. 602 (E), dated
the 31st July, 2012, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section
(i), dated the 31st July, 2012, had come to the conclusion that increased imports of Carbon Black
(for rubber application) into India from the People’s Republic of China had caused and threatened
to cause market disruption to the domestic producers of Carbon Black and it had necessitated the
imposition of definitive safeguard duty on imports of Carbon Black (for rubber application)
into India;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 8C of the said
Act, and in accordance with the rules 12, 14 and 17 of the Customs Tariff (Transitional Product
Specific Safeguard Duty) Rules, 2002, the Central Government after considering the said findings
of the Director General (Safeguards), hereby imposes a safeguard duty on Carbon Black (for
rubber application), falling under tariff item 2803 00 10 of the First Schedule to the said Act,
when imported into India from the People’s Republic of China at the rate of-
(a) Thirty per cent ad valorem minus anti-dumping duty payable, if any, when imported
during the period from 5th October, 2012 to 4th October, 2013 (both days inclusive); and
(b) Twenty five per cent ad valorem, minus anti-dumping duty payable, if any, when imported
during the period from 5th October, 2013 to 31st December, 2013 (both days inclusive).
Non-tariff Notifications
In exercise of the powers conferred by section 14 of the Customs Act, 1962 (52 of 1962), and in
super session of the notification of the Government of India in the Ministry of Finance
(Department of Revenue) No.91/2012-CUSTOMS (N.T.), dated the 4th October, 2012 vide
number S.O. 2360(E), dated the 4th October, 2012, except as respects things done or omitted to
be done before such super session, the Central Board of Excise and Customs hereby determines
that the rate of exchange of conversion of each of the foreign currency specified in column (2)
of each of Schedule I and Schedule II annexed hereto into Indian currency or vice versa shall,
with effect from 19th October, 2012 be the rate mentioned against it in the corresponding entry
in column (3) thereof, for the purpose of the said section, relating to imported and export
goods.
