Introduction
In the previous unit, we dealt with the ESIC Act. The umbrella legislation relating to gratuity is the
Payment of Gratuity Act, 1972. The Act was enacted to provide for a scheme for the payment of
gratuity to employees engaged in factories, mines, oilfields, plantations, ports, railway companies,
shops or other establishments employing ten or more persons and for matters connected
therewith or incidental thereto. The appropriate Government may, by notification, and subject
to such conditions as may be specified in the notification, exempt any establishment to which
